Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ABiZ Cargo Limited ("ABiZ Cargo", "we", "our", or "us"), a company registered in Tanzania, governing your access to and use of the ABiZ Cargo mobile application, website, and related logistics services (collectively, the "Services").
By creating an account or using any part of our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.
Business users
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. References to "you" include that entity.
Description of Services
ABiZ Cargo provides air freight forwarding, cargo tracking, warehouse management, and logistics coordination services, primarily operating routes between Tanzania and China. Our Services include:
- Cargo booking: Request, confirm, and manage air freight shipments through our platform.
- Real-time tracking: Monitor shipment status from origin to delivery via the mobile app.
- Warehouse management: Coordinate cargo intake, storage, and dispatch at our designated facilities.
- Documentation: Generate air waybills, commercial invoices, packing lists, and customs declarations.
- Customer support: In-app chat, notifications, and support ticketing.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice. We are not liable to you or any third party for any modification or discontinuation of Services.
Eligibility & Account
Eligibility
To use our Services, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into binding contracts under applicable law.
- Not be prohibited from using the Services under Tanzanian law or any applicable international regulations.
Account Registration
You must register an account to access most features. When registering, you agree to:
- Provide accurate, complete, and current information.
- Maintain the security of your password and restrict access to your account.
- Notify us immediately of any unauthorised access or suspected breach.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information or that we believe are being used fraudulently.
Bookings & Cargo
Booking Confirmation
A booking is confirmed only upon our written acceptance (including electronic confirmation sent through the app or by email). Submission of a booking request does not constitute a binding agreement until accepted by ABiZ Cargo.
Accuracy of Cargo Declarations
You are solely responsible for the accuracy and completeness of all cargo declarations, including goods descriptions, weights, dimensions, quantities, and declared values. Incorrect or incomplete declarations may result in:
- Delays at customs clearance.
- Additional charges levied by authorities.
- Seizure or destruction of the cargo by customs authorities.
- Suspension of your account and legal proceedings.
Packing & Labelling
Cargo must be packed and labelled in accordance with IATA Dangerous Goods Regulations (where applicable), airline requirements, and any destination country import standards. We are not liable for damage arising from inadequate packing.
Cancellations & Amendments
Cancellations or amendments to confirmed bookings must be requested through the app. Cancellation fees may apply depending on the stage of the shipment and the airline's own cancellation policy. We will communicate applicable fees at the time of request.
Prohibited Goods
Strict prohibition
Shipping prohibited items may result in immediate account termination, reporting to law enforcement, and personal legal liability. We cooperate fully with Tanzanian and international authorities.
You must not book or ship the following items through our Services:
- Narcotics, controlled substances, and illegal drugs.
- Firearms, ammunition, and explosive materials (without lawful licences and prior written approval).
- Human remains, organs, or biological specimens (without proper permits).
- Counterfeit goods, pirated materials, or items infringing intellectual property rights.
- Currency, negotiable instruments, and precious metals beyond customs allowances without prior declaration.
- Hazardous materials not shipped in compliance with IATA DGR requirements.
- Any goods the import or export of which is prohibited by Tanzanian law, Chinese law, or applicable international sanctions.
- Live animals, unless via a pre-approved specialist service with all required permits.
We reserve the right to inspect, refuse, or return any shipment that we reasonably believe contains prohibited items. Costs of return or disposal are borne by the customer.
Fees & Payment
Pricing
Freight charges are quoted at the time of booking confirmation and are based on actual or volumetric weight (whichever is greater), route, service level, and applicable surcharges. All prices are stated in the currency indicated on your invoice (typically Tanzanian Shillings or US Dollars).
Additional Charges
The following may give rise to additional charges beyond the quoted freight rate:
- Weight or volume discrepancies discovered at point of acceptance.
- Customs duties, taxes, and government levies imposed at origin or destination.
- Storage fees for cargo not collected within the agreed free-storage period.
- Re-handling, re-labelling, or repackaging at your request or due to non-compliance.
- Failed delivery attempts and return-freight costs.
Payment Terms
Payment is due as specified in your invoice. We accept payment by bank transfer, mobile money (where available), and other methods listed in the app. Late payments may attract interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.
Refunds
Refunds for cancelled bookings are processed in accordance with our cancellation policy communicated at the time of booking. Freight charges already incurred with airlines or ground handlers may be non-refundable.
Liability & Claims
Our Liability
ABiZ Cargo acts as a freight forwarder and logistics coordinator. Our liability for loss, damage, or delay to cargo is limited to the lesser of:
- The declared value of the cargo, as stated on the air waybill.
- The liability limits established by the Montreal Convention (17 SDR per kilogram) where applicable.
- The airline carrier's own conditions of carriage.
Limitation of Liability
To the maximum extent permitted by law, ABiZ Cargo is not liable for:
- Loss of profit, revenue, or business opportunity.
- Indirect, consequential, special, or punitive damages.
- Losses arising from delays caused by customs authorities, airline schedule changes, force majeure events, or circumstances outside our reasonable control.
- Losses arising from your failure to provide accurate cargo declarations.
- Damage resulting from inherent vice, inadequate packing, or the nature of the goods.
Cargo insurance
We strongly recommend that you arrange adequate cargo insurance for high-value shipments. Our standard liability limits may not cover the full value of your goods. Ask our team about insurance options at the time of booking.
Claims Procedure
Claims for loss or damage must be submitted in writing within:
- 7 days of delivery for visible damage.
- 14 days of delivery for concealed damage.
- 21 days of the scheduled delivery date for total loss or non-delivery.
Claims submitted outside these periods will be denied unless we caused the delay through gross negligence or willful misconduct. Submit claims via our in-app support or to claims@abizcargo.com.
Intellectual Property
All content, software, trademarks, logos, designs, and materials in or related to the Services are the exclusive property of ABiZ Cargo Limited or our licensors. No licence to use our intellectual property is granted except as expressly provided in these Terms.
You must not:
- Copy, modify, distribute, or create derivative works from our software or content without written permission.
- Reverse engineer, decompile, or disassemble the app.
- Use our trademarks or branding in any manner likely to cause confusion.
- Scrape, spider, or systematically extract data from our platform.
User Conduct
When using our Services, you agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable regulation.
- Attempt to gain unauthorised access to any part of the platform or other users' accounts.
- Introduce viruses, malware, or other harmful code.
- Engage in conduct that disrupts, damages, or overburdens the Services or associated infrastructure.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Harass, threaten, or abuse our staff or other users.
- Submit false, misleading, or fraudulent booking information.
We may investigate violations and take appropriate action, including account suspension, legal proceedings, and cooperation with law enforcement.
Termination
By You
You may close your account at any time by contacting us. Closure of your account does not release you from outstanding payment obligations or ongoing shipment commitments.
By Us
We may suspend or terminate your account immediately if:
- You breach any material term of these Terms and fail to cure within 7 days of notice.
- We believe your account is being used fraudulently or for illegal purposes.
- Required by law or a government authority.
- We discontinue the Services.
Effect of Termination
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including liability, intellectual property, and governing law clauses) will remain in effect.
Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ABiZ Cargo makes no warranties — express or implied — regarding:
- The accuracy, completeness, or timeliness of tracking information.
- Uninterrupted or error-free operation of the app or website.
- Fitness of the Services for any particular purpose.
- Actions or omissions of airline carriers, customs authorities, or third-party logistics providers.
Transit times and estimated delivery dates are estimates only and are not guaranteed. Delays caused by weather, customs inspection, regulatory holds, or force majeure events are outside our control.
Governing Law & Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Where the Montreal Convention applies to international carriage by air, its provisions prevail over these Terms to the extent of any inconsistency.
Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms or the Services, the parties agree to:
- Good faith negotiation: Attempt to resolve the dispute through direct discussion within 30 days of written notice.
- Mediation: If negotiation fails, submit to non-binding mediation administered by a mutually agreed mediator in Dar es Salaam.
- Courts: If mediation is unsuccessful, submit to the exclusive jurisdiction of the courts of the United Republic of Tanzania.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from any court of competent jurisdiction.
Changes to Terms
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will provide at least 14 days' notice through the app, by email, or by posting a prominent notice on our website. The updated date at the top of this page reflects the latest revision.
Your continued use of the Services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services before the effective date.
